Legal, Verification & E-Sign Consent

This page explains what FleetTrained's training records, certificates, and verification tool are and are not, the responsibilities of the companies that use them, and your consent to electronic records and signatures. It supplements our Terms of Service, Privacy Policy, and Refund Policy; where this page and the Terms of Service address the same subject, read them together. By creating an account, assigning training, completing training, or signing electronically, you agree to this page.

1. What FleetTrained is — and is not

FleetTrained is a private company that produces driver-training videos and provides an online platform on which an employer can assign training to its drivers, quiz them, capture an on-screen signature, and issue completion records. FleetTrained is not a government agency, a regulatory authority, an accreditation or certifying body, a law-enforcement or judicial entity, or a provider of legal advice. We do not license, certify, or qualify drivers, and we do not represent any government program.

2. What a certificate and completion record mean

A FleetTrained certificate or completion record evidences one thing: that the named individual, within the named employer's account, opened the named training module, answered its quiz at the score shown, attested to watching it, and applied an on-screen signature on the date and time shown. That is all it represents.

• It is a record of training completion, not a government-issued credential, license, endorsement, or permit.
• It is not a certification of a driver's skill, competency, fitness, or safety, and it does not guarantee that any driver will drive safely or lawfully.
• It is not a determination or warranty that any law, regulation (including any FMCSA or DOT rule), insurance requirement, court standard, or company policy has been satisfied.
• It does not transfer, reduce, or assume any of the employer's legal or regulatory obligations.

3. The verification tool

Each certificate carries a reference code and a QR code linking to our public verification page (fleettrained.com/verify). Anyone may scan the code or enter the reference to confirm whether a matching completed record exists in our system as issued. The verification tool:

• Confirms only that a record with that reference exists in FleetTrained's system and reproduces the data the employer and driver entered or generated;
• Does not attest to the truth of the underlying facts, the identity of the person who took the training, the adequacy of the training, or the legal sufficiency of the record for any purpose;
• Is provided "as is" and "as available," without warranty, and may be unavailable, changed, or discontinued at any time.

Any court, officer, insurer, auditor, broker, or other third party that relies on a certificate or the verification tool does so at its own discretion and risk. FleetTrained makes no representation or warranty to any third party and owes no duty to any third party who relies on a record.

4. The employer is the training provider and record owner

The employing company (the account holder) — not FleetTrained — decides who is trained, assigns the training, confirms attestations, and is the provider and owner of the resulting records. The employer is solely responsible for: the accuracy of the driver and company information it enters; obtaining any consent needed to train and record its drivers; determining what training its operation legally requires; and deciding whether and how to rely on any certificate. FleetTrained stores and processes these records on the employer's behalf and under its instruction (see the Privacy Policy).

5. Electronic Records & Signatures Consent (E-SIGN)

FleetTrained conducts training, attestations, signatures, agreements, and record-keeping electronically. This section is your consent under the U.S. Electronic Signatures in Global and National Commerce Act (E-SIGN Act, 15 U.S.C. §7001 et seq.) and comparable state laws (such as UETA).

• Consent to electronic records and signatures. By creating or using an account, accepting this page, completing training, checking a consent box, or drawing and submitting a signature, you agree that (a) you intend to sign electronically, (b) your electronic signature (a drawn signature, a checked box, a click, or account acceptance, as applicable) is your legal signature and is as valid and enforceable as a handwritten one, and (c) you consent to receive and retain the related records — assignments, agreements, quiz results, attestations, certificates, acknowledgments, and notices — in electronic form.
• Association. Each electronic signature is captured with, and stored as part of, the specific record it applies to, together with the date and time it was created.
• Hardware and software you need. To access and retain electronic records you need a current web browser, internet access, an email address, and the ability to view and save PDF and image files. If these requirements change in a way that creates a material risk you cannot access or retain records, we will notify you.
• Paper copies. You may request a paper copy of any record. A driver may request a paper copy of their certificate or acknowledgment from their employer; an account holder may request a paper copy from us at the contact below. We may charge a reasonable fee for paper copies.
• Withdrawing consent. You may withdraw consent to do business electronically by contacting us; withdrawal applies going forward only and does not affect records already created. Because FleetTrained is an electronic service, withdrawing consent means you can no longer use the platform.
• Retention. We retain completed training records and their signatures so they remain available to the employer and reproducible through the account and the verification tool, consistent with our Privacy Policy.

6. No legal advice

Nothing on FleetTrained — including videos, quizzes, certificates, this page, and any statement about regulations — is legal, compliance, or professional advice. Regulations change and vary by jurisdiction and operation. You are responsible for confirming current requirements (for example, at fmcsa.dot.gov) and, where appropriate, consulting your own attorney, insurer, or compliance professional.

7. Disclaimers & limitation of liability

To the maximum extent permitted by law, the platform, the certificates, and the verification tool are provided "as is," and FleetTrained disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. FleetTrained is not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising from any person's or entity's reliance on a certificate or the verification tool. To the maximum extent permitted by law, FleetTrained's total liability arising out of or relating to the platform, a certificate, or the verification tool will not exceed the amount you paid to FleetTrained for the service giving rise to the claim in the twelve months before the claim. Some jurisdictions do not allow certain limitations, so some of these may not apply to you. Additional limitation and indemnity terms in our Terms of Service also apply.
