What exactly is the roadside English test?

Since June 2025, FMCSA guidance lets an officer assess a commercial driver's English at any inspection under 49 CFR 391.11(b)(2). The driver must answer basic questions and explain highway signs in English. If they can't, they're placed Out of Service.

Does the driver sign the assessment?

No. Only your safety manager signs the ELP record — it's their attestation that they conducted the assessment in English, in person, with no interpreter or translation apps, mirroring the roadside protocol.

Is ELP an extra charge?
